These terms cover the use of this website and participation in the DutyTick private preview. They do not cover a paid subscription. Any paid service will be governed by a separate agreement.

DutyTick is operated by Hardcode Consulting Private Limited, a company registered in India, referred to here as we and us. By using this site or asking for early access, you accept what follows.

What the private preview is

An invitation to a limited number of companies to use the product before release and tell us where it falls short.

Registering interest is not a contract, a purchase or a promise of access. We decide who is invited and when. The preview is provided free of charge.

What we ask of you

• Give us accurate information, and use an address you actually control.
• Tell us what works and what does not.
• Do not use the preview for anything unlawful, and do not attempt to break or overload the service.
• Do not decompile, reverse engineer, probe for vulnerabilities, or work around limits set within the software. If you come across a security problem, tell us.
• Do not put data into the preview that you are not entitled to put into third party software. If you are unsure, ask your own advisers first.

Publication

The preview is unfinished software and will have defects and missing functionality.

While the preview is running, do not publish screenshots or recordings of it, and do not give your access to anyone outside your organisation. Report defects to us instead.

This restricts publishing the unreleased software itself, not discussion of it or of your participation. It lapses on release.

What we undertake

• To handle personal data as set out in the privacy policy.
• Not to name you publicly as a participant without your agreement.

What we do not promise

There is no availability commitment, no support commitment, and no assurance that any feature will appear in the released product or behave the same way. Data entered during the preview may be reset without notice.

The preview is provided as is and as available. To the extent permitted by law, no warranties are given, express or implied, including as to quality, fitness for a particular purpose, accuracy of output, or non-infringement. It should not be relied on as a system of record.

Nothing here commits us to release the product, on any date or at any price.

Feedback

Suggestions, ideas and defect reports you give us may be used freely, without payment, credit or restriction.

This does not extend to your confidential business information or your data, which remain yours.

Communications

Registering interest means submitting the early access form, or writing to us. It is a request rather than a subscription: we send one confirmation back, we answer the request, and we do not add you to a mailing list. See the email policy.

Service messages about the preview itself are not marketing and continue regardless.

The website

The content, design and code of this site are ours. You may quote it with attribution and link to it. You may not reproduce it wholesale or present it as your own.

The DutyTick and Hardcode Consulting names and marks are ours. Other names belong to their respective owners.

The site is provided as is, without any assurance of accuracy or availability.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Otherwise, our total liability arising from the preview or this website is limited to one thousand rupees. We are not liable for loss of profit, business, data, or any indirect or consequential loss.

A paid agreement, when one exists, will carry its own liability terms.

Ending it

You may leave the preview at any time. Write to us and we will close your access and delete your data, subject to the retention terms in the privacy policy.

We may end the preview, or your participation in it, at any time.

Changes

We may change these terms. Where the change is material the date at the top changes. Continued participation after that constitutes acceptance.

Law and disputes

These terms are governed by the laws of India.

Any dispute should first be raised with us directly. Failing resolution, it is to be referred to arbitration by a single arbitrator under the Arbitration and Conciliation Act, 1996, seated in Kolkata and conducted in English. The courts at Kolkata, West Bengal have exclusive jurisdiction over matters not subject to arbitration.
